These Terms of Use (the "Terms") govern your access to and use of BrioVocab. By creating an account, installing the app, or using any part of the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

BrioVocab is operated by Vasily Pintov.

Email is the fastest way to reach us with any question or complaint about the Service or these Terms.

2. What these Terms cover

These Terms apply to the BrioVocab website (briovocab.com), the web app (app.briovocab.com), the BrioVocab mobile apps for Android and iOS, the Telegram mini app, and the VK mini app. We refer to all of these together as the Service.

How we handle your personal data is described in our Privacy Policy.

3. Your account

You are responsible for the activity that happens under your account and for keeping access to your sign-in methods secure. You must provide accurate information about yourself. The Service is not directed at children under the age required by the law of your country to consent to the processing of personal data.

4. License and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own language learning.

You agree not to:

  • copy, sell, rent, redistribute or publicly make available the Service content (word lists, definitions, audio, images, exercises) outside of your personal use;
  • reverse engineer, scrape, or access the Service by automated means except through interfaces we provide;
  • interfere with the operation or security of the Service;
  • use the Service to violate any applicable law.

5. User content

Some features let you create or submit content, such as messages to the AI assistant, custom word collections, voice recordings and images. You keep the rights to your content and grant us a license to process it as needed to operate the Service. You must not submit content that is illegal, infringes the rights of others, or violates the content rules shown in the app. We may remove content and restrict accounts that violate these rules.

6. Subscriptions: BrioVocab AI

The Service offers free features and a paid auto-renewable subscription called BrioVocab AI.

  • Length of subscription: 1 calendar month per billing period.
  • What it includes: unlimited training sessions and a monthly allowance of AI credits for AI-powered tools.
  • Price: the full price of the subscription, including the price of each renewal, is shown on the purchase screen in the app and in the store listing before you confirm the purchase. Prices may vary by country and by payment platform.

6.1 Auto-renewal

  • The subscription renews automatically at the end of each billing period unless you cancel it at least 24 hours before the end of the current period.
  • Payment is charged to your payment method, and for store purchases to your Apple App Store or Google Play account, at confirmation of purchase; the renewal charge is made within 24 hours before the start of the new period.
  • Cancelling stops future renewals. You keep access to paid features until the end of the period you have already paid for.

6.2 How to cancel

  • Apple App Store (iOS app): open your device Settings, tap your Apple Account, then Subscriptions, and cancel BrioVocab AI. Subscriptions bought through the App Store are managed and cancelled only through your Apple account.
  • Google Play (Android app): open the Google Play app, go to Payments and subscriptions, then Subscriptions, and cancel BrioVocab AI.
  • Website, Telegram or VK purchase: follow the instructions on the subscription screen in the app, or email us at vasily@briovocab.com.

6.3 Refunds

  • Purchases made through the Apple App Store are billed by Apple and refunded under Apple's refund rules; request a refund at reportaproblem.apple.com.
  • Purchases made through Google Play are billed by Google and refunded under Google Play's refund rules.
  • Purchases made on the website by card are governed by the applicable purchase terms shown at checkout; for purchases under Russian law, see the Public Offer. To request a refund, email vasily@briovocab.com.

7. AI credits

AI credits are consumable units used by AI-powered tools. Credits included in a subscription are an allowance for the current billing period. Additionally purchased credit packs are one-time consumable purchases, not subscriptions, and do not renew. Credits have no cash value, are non-transferable, and are not refundable once consumed, except where a refund is required by the rules of the store you bought them from or by applicable law.

8. Changes to the Service

The Service evolves: we may add, change or remove features, content and free-tier limits. If a change materially reduces what an active paid subscription includes, you can cancel the subscription as described above.

9. Additional terms for the iOS app (Apple App Store)

If you use the BrioVocab iOS app downloaded from the Apple App Store, the following additional terms apply:

  • These Terms are an agreement between you and Vasily Pintov only, not with Apple Inc. ("Apple"). Vasily Pintov, not Apple, is solely responsible for the app and its content.
  • The license granted to you is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  • Apple has no obligation to furnish any maintenance and support services with respect to the app.
  • In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.
  • Vasily Pintov, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
  • In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Vasily Pintov, not Apple, is solely responsible for the investigation, defense, settlement and discharge of such claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms of agreement when using the app.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted or error-free, or that AI-generated content will be accurate; AI output may contain mistakes and is provided for learning purposes only.

11. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claims arising out of or relating to the Service or these Terms is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 10, 11 and this Section) survive.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always available at this page, with the "Last updated" date above. If a change is material, we will take reasonable steps to notify you in the app or by other means. Continued use of the Service after a change takes effect means you accept the updated Terms.
